Use of Personal Data
The data and information that you share with BlueBoard, including while browsing the Website or in the order and/or registration form or during the conclusion of a contract with BlueBoard, includes personal data. This personal data includes:
- First name
- Phone number
- Email address
- any information, data, or content provided or generated by you while using the Website (e.g. IP address) or while completing an online form, including the support contact form
is subject to automatic processing and is stored on the BlueBoard information system and database.
You expressly consent to the collection, storage, use, and IT processing of this personal data under the conditions described below.
Data processing is subject to the French “Informatique et Liberté” law of January 6, 1978, amended, and from May 25, 2018, to Regulation 2016/679 of the European Parliament and Council of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free circulation of such data (hereinafter “GDPR”).
BlueBoard is responsible for data processing.
The personal data is intended for BlueBoard, other users who are customers of BlueBoard and the Website host.
Processing personal data is necessary for the purposes of:
- Concluding and executing the Contract between you and BlueBoard until its term to allow the provision of the services that you have subscribed to with BlueBoard;
- Building and maintaining your dashboard on BlueBoard (Article 6.1a and b of the GDPR);
- Enabling the management, processing, and tracking of all of your BlueBoard accounts,
- Allowing BlueBoard to contact you and analyze your needs in accordance with the social purpose of BlueBoard and the purpose of the Website;
- Ensuring the payment due to BlueBoard and carrying out invoicing;
- Commercial prospection, notably the sending of information, including commercial information, from BlueBoard and/or its partners or affiliates, such as service or Website updates, newsletters, new offers, and news.
The failure to collect and process this personal data and/or the refusal to consent to this processing and/or the exercise of your rights, referred to below, hinders the proper achievement of the purposes referred to above by BlueBoard and may render the BlueBoard Website and/or services inaccessible and/or prevent the proper execution of the Contract.
In accordance with Articles 15-22 of the GDPR, for the data concerning you, you have a:
- Right to access;
- Right to rectify and remove;
- Right to limit processing;
- Right to transfer data;
- Right to oppose;
- Right not to be subject to a decision based solely on automatic processing; and
- Right to withdraw your consent to the processing of your personal data without violating the legality of the processing based on your consent carried out before its withdrawal.
You may exercise your rights at any time by making a written request to email@example.com, accompanied by any means of proving your identity and including your surname, first name, and email address. BlueBoard may, at any time, request additional elements in order to confirm your identity.
BlueBoard will reply to your request within one month of receiving it. This timeframe may be extended to two months in the event of a complicated request or several requests.
If BlueBoard does not pursue your request, you will be informed of the reasons for their inaction within a month of them receiving the request.
No payment will be requested for the exercise of your rights. However, BlueBoard may, if your requests are obviously unfounded or excessive, including due to their repetitive nature, either demand payment of reasonable administration costs for processing your requests or refuse to pursue your requests.
BlueBoard notifies each recipient to which the personal data is communicated of any rectification or removal of personal data or any limitation of the processing carried out unless such communication is impossible or involves disproportionate efforts. BlueBoard will provide information on these recipients if you so request. You have the right to make a claim to the French control authority, the national commission on IT and freedoms (Commission Nationale de l’Informatique et des Libertés or CNIL).
If you request the removal or limitation of your data or you object to processing, this may make it impossible for BlueBoard to provide the service requested and the Contract, for which the personal data is necessary for its execution, may cease. In any case, you can oppose the use of your personal data for the purpose of commercial prospection without providing a reason for this.
In the event of violation of personal data, and if this is likely to result in a high risk to your rights and freedoms, BlueBoard will inform you of the violation as soon as possible unless sufficient protective measures have been applied to the data, if later measures can guarantee that the risk will not be repeated, or if providing you with this information would involve disproportionate efforts.
To find out more, you can consult your rights on the CNIL website: https://www.cnil.fr/fr/comprendre-vos-droits.
Data retention period:
- Concerning processing for the conclusion and execution of BlueBoard services: until the Contract comes to its term and afterward if suspended elements remain (unpaid invoices, disputes, claims, etc.);
- Concerning commercial prospection: three (3) years after your last response to a solicitation.
BlueBoard is authorized to share your personal data if this data must be revealed following a legal or administrative injunction or if its communication is necessary for BlueBoard to defend itself in the context of legal or administrative proceedings.
